How much do you keep when you sell your flat in Spain?
Checked on 08/10/2026
Enter the sale price and what you paid for the flat: the page shows what lands in your account on the day you sign and what you keep once everything is paid. It asks for nothing before showing the result.
If you do not know yet what the agency will charge, we use the usual range of 3% to 5% plus 21% VAT, and we say so: it is what you agree with the agency, not an official tariff. The taxes do come from the rules in force, listed below with the date we read them.

Your result
What you keep after everything (range using 3% and 5% commission)between €227,251 and €232,031
The energy certificate and mortgage cancellation costs are not counted, except what you typed.
Estimate from your figures. The gain is the sale price, less your selling costs (commission and plusvalía), less the acquisition value (price and purchase costs).
This is an estimate, not tax or legal advice. The rules have exceptions and change: confirm your case with a professional before you sign.
You have an idea of the figures: ask local agencies for a valuation of your property.

How it is worked out
Capital gain = sale price, less the agency commission with its VAT and the municipal plusvalía, less the acquisition value (what you paid plus the purchase costs). If it comes out negative, there is no tax on the sale.
If you live in Spain, the gain is taxed in the IRPF savings base: 19% up to €6,000, 21% up to €50,000, 23% up to €200,000, 27% up to €300,000 and 28% above. That scale is the state one (article 66 of Ley 35/2006) plus the regional one (article 76); the Comunitat Valenciana sets no other in its Ley 13/1997. If you have other savings income, your real band can be higher.
If you do not live in Spain, the gain is taxed at 19% under the non-resident tax (IRNR), whether you are from the EU or not: 24% is the general rate for other income, not the rate on property sales. The buyer withholds 3% of the price and pays it in with form 211; you then file form 210, deduct that withholding and pay the difference or get the excess back.
The agency commission carries 21% VAT, the general rate. The commission percentage is not a rule: it is what you sign with the agency.
What this calculation leaves out
Municipal plusvalía depends on your town hall's bylaw: if you already know the figure, type it and we subtract it.
The costs of cancelling the mortgage (notary, registry, bank fee), the energy certificate and the habitability certificate.
Other savings income you have in the year, which can raise your band.
The main-home exemption is only taken as given if you tick it: it has conditions that a professional should check.
Deadlines to know
Municipal plusvalía: 30 working days from the sale (article 110.2.a of the Local Finance Law). If you sell without being resident in Spain, the buyer is the substitute taxpayer.
Non-residents: the buyer pays in the withholding with form 211 within one month of the sale, and you file form 210 within the three months that follow that month.
Residents: the gain goes into the income tax return for the year of the sale.
Frequently asked questions
How much does an estate agent charge to sell a flat in Spain?
There is no official tariff: the commission is what you agree with the agency. The usual range is 3% to 5% of the price, plus 21% VAT. Ask for it in writing and compare.
Do I pay tax if I sell at a loss?
You pay no tax on the gain if there is no gain. Other costs may remain, such as municipal plusvalía, which in some cases is not due if the land value has not risen.
I am British and live in the UK: do I pay 24%?
No: the gain on selling a property is taxed at 19% for any non-resident, according to the consolidated non-resident tax law and the Tax Agency itself. 24% is the general rate on other income, such as rent.
What is the 3% withholding when I sell as a non-resident?
It is a payment on account that the buyer makes to the Tax Agency: 3% of the price. It is not the final tax: you settle it with form 210, and if you paid too much you get the difference back.
Can I sell without an agency?
Yes. Then there is no commission, but you prepare the paperwork yourself. Tick "I sell without an agency" to see the difference.
